Assistance in Court

Our McKenzie Friends have extensive experience assisting individuals from various backgrounds, including those highly successful in their fields. Indeed, the family court system can often seem confusing, bureaucratic, and lacking in logical processes and outcomes.

Approaches that may be reasonable and common sense outside of the system can often be viewed by the court as unreasonable and damaging. This frequently leads to frustration and confusion among parties who expected the court to function in a more straightforward manner, like other systems they are familiar with.

The family court system, for various reasons, is often slow and cumbersome. Matters that may appear relatively simple and should be resolved quickly can drag on. In the meantime, costs will continue to accumulate. It is therefore crucial not to take actions that may further slow the process. Instead, you will want to assist the system in moving as efficiently as possible. The skills and experience of our McKenzie Friends are invaluable in this regard.

Even if you are a confident speaker and well-informed about the court process, representing yourself is generally not recommended. Seemingly straightforward hearings can involve technical points and essential decisions must be made quickly, with little or no support from the court. Our McKenzie Friends accompany you to court or participate in remote telephone/video hearings. We help to ensure that you make the right decisions and present your case to the court effectively, to achieve a positive outcome. We will guide you to avoid the mistakes that many parties make when navigating this bewildering system.

During court proceedings, our experienced and knowledgeable McKenzie Friends can draft a concise Position Statement that efficiently presents your views and requirements to the judge. With individually drafted Position Statements for each hearing, the court will be made aware of the arguments in your favour and why your proposals should be favoured.

It is imperative to present your views to the court in the most efficient manner possible. A Position Statement, whether brief or more comprehensive, is vital in your efforts to persuade the court to support your options. There are very few instances where a well-crafted and succinct Position Statement is not necessary to maximize your success in a hearing.

In court, at your request, our McKenzie Friends can engage in discussions with the solicitors and barristers representing the other party (or the litigant in person). We can also assist you in direct negotiations. Our McKenzie Friends will provide you with information about any proposals or other matters that may arise, including legal considerations.

While in court, our McKenzie Friends will sit next to you in court, or participate in remote telephone/video hearings, and provide relevant information as needed. We will have thoroughly briefed you prior to the hearing, ensuring you are aware of what is likely to transpire. They will remind you of important points that were discussed before the hearing by passing you notes or quietly providing guidance. We also assist in making submissions, addressing technical points, presenting evidence-in-chief, and conducting cross-examinations. With a McKenzie Friend by your side, you are far more likely to fully understand what is happening and respond effectively during the proceedings.

The guidance of a skilled, knowledgeable, and experienced McKenzie Friend will significantly impact the outcome of your case and reduce the time you spend within the system.
