Property
When parties have been married the court has broad powers to redistribute assets during financial remedy proceedings. There is generally little relevance attached to whether the matrimonial home is in joint names or in the name of one party, it will be usually be treated as a family asset.
When there is more than one property, perhaps a matrimonial property and a non-matrimonial property the courts will generally not make any strict determination in the parties respective claims of proprietary interests in a property. However, the timing and manner of acquisition of a property by one of the parties may be noted but the broad brush approach by the court will generally find it unhelpful and unnecessary to take more than a cursory look. During the marriage if there has been considered planning of the distribution of properties it may be a factor but it will still only be one of a number of factors the court will take into consideration.
Where there are third party interests in a property or where a spouse is bankrupt then the court will have to determine the property interests of the husband and wife in a formal way.
The meeting of housing needs is not the sole purpose of a property order, a property order being an order where a transfer of property is made to the other party. Property is normally land or a house but can be personal property such as shares, chattels (possessions including contents) or perhaps the dog.
Housing needs are a high priority and particularly when finances are low when the property may be the only asset therefore this is usually seen as appropriate to consider as a preliminary. The primary carer’s need to make a home for the children is important but it was important, albeit of lesser importance that the other party should also have a home where the children could enjoy time with that parent. When assets are severely limited then the courts may see it that the needs of one of the parties have to give way to the needs of the family as a whole and the requirement to treat the welfare of children as the first consideration. This does not mean that the former matrimonial home should be continued to be lived in, if the primary carer and the children can be satisfactorily rehoused in a lower cost home and then releasing capital for the other parent, this might be an appropriate option.
Occupying a property with the children does not give sole ownership to that party, various options are available if immediately selling the former matrimonial home is not regarded as appropriate.
An outright transfer is an order where one party transfers their interest in a property to the other party. It is important to note that if the property is mortgaged then the party taking over sole interest in the property should secure the release of the co-owner from the mortgage, otherwise the mortgagee (bank) could still hold the party who has transferred their interest (to the other party) liable under the mortgage covenants.
A transfer subject to charge is where a sum of money in favour of the party relinquishing their interest in the property would be required on a fixed date or a named event or death or remarriage or the children attaining a certain age. These monies could be in the form of a fixed amount or a percentage of the sale of the property.
A mesher order enables the former matrimonial home to be sold at a later time, usually when the children are no longer dependent. A martin order enables the former matrimonial home to be sold at a time some time after the children are no longer dependents. Both mesher and martin orders are relatively unusual orders for the court to make.
If the property is under a tenancy agreement (private sector) then these are normally shorthold tenancies which have covenants within the agreement stopping an assignment or are of a short period so will not be worth the court transferring. Tenancies involving the local authority or social housing are more likely to be able to be transferred to one party by the court but the existing agreement would have to be checked carefully, the position not always being readily clear.
When properties may have to be sold within financial remedy proceedings then an order for sale is available to the court.
In Schedule 1 applications under the Children Act 1989 (parties never married) for the minority or until full-time tertiary education a property can be settled for the benefit of children.

After 18 months of sky high legal fees that I could no longer afford, I had no choice but to represent myself and take on my former husbands’ London based legal team with the help of Colin Brealey. My case began as a relatively simple one, seeking to extend my shared residence of my children to include one midweek overnight stay during term time, rather than simply taking them out for tea after school and returning them to their mother.
Things became more complex when false allegations of violence against the children were made by the children’s mother against my fiancée. Social Services intervened, with both my fiancée and I unable to see the children for a period of time whilst investigations took place. Social Services thankfully saw through the allegations and determined that my fiancée posed no risk to the children.

Although I had an idea of what I had to do next with regard to starting legal proceedings I knew I needed help. I visited my local Families Need Fathers meeting and met Mr Colin Brealey who chairs the monthly meetings.

I met Jeff at my local FNF meeting. I was immediately struck not only by Jeff’s technical expertise but also by the calm, measured and authoritative way in which he gave others help and support.
I didn’t even bother looking for a solicitor, I engaged Jeff as my McKenzie Friend. He helped me file an application to court and draft a position statement. He subsequently helped support me in court.
In court Jeff was a rock-steady mentor, providing pragmatic and clear advice at just the right time. He negotiated with the other side and his clear familiarity with the system filled me with confidence in the waiting before the hearing. The mother had applied for sole residence and proposed one Wednesday overnight a fortnight and every other weekend Friday to Sunday 6pm for contact. No holidays, other than alternate Christmas day.
I ended up with an SRO by consent, every Wednesday overnight and every other weekend Friday nursery pick up to Monday nursery drop off. I also got half of all holidays and alternate Christmas and Easter.
I am confident that with Jeff’s help, support and guidance I got the best outcome for my son; the long weekends and holidays in particular will help immensely in his relationship with me, his grandparents and his young cousin. I am sure I wouldn’t have secured such a good outcome for my son without Jeff’s calming influence, help and guidance.

Previous experience had also taught me that attending court is an overwhelming and daunting experience so I was conscious that I needed some form of guidance to see me through to the end. Long story short, my ex-partner dropped her application completely after the first hearing and I was able to amend the existing contact order we had in place to provide for more time with my daughter at weekends and school holidays. The result is my relationship with my daughter is as good now as it’s ever been and I feel that I have been treated fairly by the courts. This is all thanks to Jeff.

Jeff writes the most wonderful position statements. Whenever I received them, I was in awe of how he was able to state everything that needed to be said in such a laconic, precise way and always with the perfect tone. “Well just back from my Fact-Finding hearing where I had DV, with Ex and Kids, Social Services and CaFcass reports unhelpful and didn’t want to make a decision. My Mckenzie friend coached me superbly and we went into court. 3 lady magistrates and the ex had Barrister. From the opening statement from the Barrister more accusations and request for an adjournment. To my relief and contrary to what people stated the magistrates unpicked her motives. Directed her counsel to agree on a position for contact by midday. The counsel started with supervised contact for a day to more than one day supervised, my Mckenzie friend played hardball we walked out the court with unsupervised for 2 days first month, 4 days next month then Alternative weekends moving forward. This is something reading posts I didn’t expect and I’m so chuffed. I have my boys back in my life and I choked when the magistrates emphasised the impact on kids and the legal implication if the order wasn’t upheld. So for all you fathers out there follow your heart do your research and more importantly don’t give up. I’m planning some fun times for my boys with the money I don’t have to spend fighting bitter accusations. Thanks to all and don’t go into court thinking they are against you !!!”
